What is BiP?
BiP is a free communication and life platform developed entirely by Turkish engineers, available to all operator subscribers, where you can experience instant messaging, audio and video calls, and get service from the Keşfet section. Thank you for using BiP!
What Can You Find on This Page?
The BiP Terms of Use (shortly “Terms”) on this page contain basic information about using BiP (“Service”) via the mobile application or website (web.bip.com) as well as some rules that we mutually agree to comply with.
As you scroll down the page, you will see the following titles:
We understand that reading this text can be exhausting. We try to make your life as easy as possible by providing a short and concise explanation. We recommend that you carefully read these Terms. You must accept the Terms in order to use BiP. You should not use BiP if you do not agree with any part of what is written. You are deemed to have accepted these terms by signing up for BiP or accessing BiP via web.bip.com.
BiP İletişim Teknolojileri ve Dijital Servisler A.Ş. reserves the right to terminate your use of BiP if it determines that you have violated the Terms of Use or if it has a reasonable belief that you have. You can find more information under the “Suspension and Termination” heading below.
In addition to what is explained here, we have a clarification text (BiP Privacy Policy) regarding the processing of your personal data that you share in order to use the Service and that occurs during your use. Details about the processing of your personal data can be found here.
Application Ownership Information
BiP is offered by BiP İletişim Teknolojileri ve Dijital Servisler A.Ş. (“BiP İletişim” or “us”), headquartered at Aydınevler Mahallesi İsmet İnönü Cad. Küçükyalı Ofis Park B Blok Apt. No:20 Maltepe/Istanbul, registered with the company number of 124470-5, holding taxpayer number of 8710842486.
The features and services offered within the scope of your use of BiP may differ depending on the geographical region you are in, the region you are in, the operator you use, and some of them may be offered for a fee. You may enter into a contractual relationship with third parties with whom BiP İletişim collaborates in this context. In this case, we remind you that the provisions of the relevant contracts, in addition to these Conditions, will apply.
General Conditions
Restriction on Age To use BiP, you must be at least 13 years old (or the age at which your country’s law allows you to use the Service without parental or guardian consent).
You must first create a membership in order to use BiP. When registering with BiP, you should not make any false statements, use your current phone number, and if your phone number changes, you should register with BiP using your new phone number. By registering with BiP, you agree to receive messages and/or phone calls containing registration codes to be used to verify your phone number from us or third-party service providers.
If it is determined that you do not meet the requirements for membership, BiP letişim may take any of the actions listed under the heading “Suspension and Termination.”
By registering with BiP, you agree to share the phone numbers of your contacts, including BiP users, with us on a regular basis. This is required for BiP to function properly. BiP Privacy Policy contains more information on the subject.
If you create an account on BiP, you must keep your username, password, address, and payment information private and not share them with anyone. If you believe or suspect that someone other than you has this information, please contact us right away at info@bip.com .
Links BiP provides links to third-party websites solely for your convenience or when communicating with other users. You will leave BiP if you use these links. BiP letişim has no control over these websites and is not responsible for their contents or accessibility. BiP İletişim does not support or represent these websites or the materials on these websites in any way. It is entirely your responsibility to navigate to third-party websites from BiP.
DModifications and corrections BiP letişim reserves the right to revise and correct the content of the Terms of Service at any time. You should control this section from time to time to learn about the changes we have made. If we make a significant change to our Terms of Service, we may make it more visible (including via e-mail or BiP).
Transfer BiP İletişim reserves the right at any time and without prior notice to transfer BiP and/or its rights and obligations under these Terms to any third party or organization. This has no bearing on your obligations under the terms of these Terms. Under no circumstances may you transfer or assign your rights, obligations, or responsibilities under these Terms to third parties.
Terms of Use
This section contains additional special rules that you must follow in addition to the other requirements in the Terms when using BiP.
When using BiP, you accept and commit
otherwise, you agree and commit to being personally liable for such actions.
Pricing, Renewal and Cancellation, Yenileme ve İptal
Pricing BiP is offered free of charge. Some of the channels and services in the BiP Keşfet area may be charged. You can learn more about these through the appropriate channels and services.
To use paid channels and services, you must pay the fee set by the channel and service you have chosen. If you fail to meet this payment obligation, your access to channels and services may be suspended or terminated.
You are responsible for the internet access required to use BiP, as well as any fees or responsibilities that may arise as a result of it. BiP İletişim will not be held liable if you are unable to access or benefit fully from BiP due to reasons originating with your internet service provider.
You must use the most recent version of BiP for it to function properly. Supported devices and versions can be found on the BiP pages in the respective app stores. Older versions of BiP may be excluded from the scope of support that BiP İletişim deems appropriate. As a result, BiP İletişim will not be held liable if you are unable to access or benefit fully from BiP.
Cancellation and Renewal If you want to cancel your BiP membership, simply delete the BiP application from your device by following the manufacturer’s instructions.
The terms for renewing and canceling your paid memberships within the scope of Keşfet channels and services may differ depending on the relevant channel and service, and the conditions communicated to you by the mentioned Keşfet channel and service will apply.
Intellectual Property Rights, Contents and License
Intellectual Property Rights BiP İletişim owns or controls all intellectual property rights pertaining to the BiP application, BiP brands, trade names, logos, domain names, and all other elements of the BiP brand and the Content, excluding the open source codes used in BiP. All of the aforementioned rights are safeguarded by copyright laws and international treaties around the world. The open source codes used in BiP, as well as the principles governing their use, can be found under the “Copyright” tab in the Help section of the Settings tab in BiP. You may use the open source codes contained herein only in accordance with the relevant open source code’s terms of use.
The License We Grant to You for Your Use of BiP is non-exclusive, non-transferable, and revocable for your personal, non-commercial use only, excluding any open source code that may be available to you, provided that you accept these Terms. As a result, we declare that you should not act beyond the scope of the specified license, or else you may face legal consequences.
All content (“Content”) in BiP including that created by the user (“User Content”), is for the user’s personal use only. Any commercial use of the contents is strictly forbidden. Otherwise, BiP İletişim reserves all types of compensation rights.
We declare that you will be personally liable for any intellectual and industrial rights violations that may result from your use of the content in violation of these Terms, and BiP İletişim may seek damages and losses from you, including the fees it will have to pay to the right holders as a result.
User Content and the Rights You Grant Us
The rights you grant us here will be limited to the purposes of properly operating BiP and providing our service to you (for example, publishing your profile information, photo and status updates, forwarding the messages you send to the recipients), as well as other purposes stated in the BiP Privacy Policy.
BiP İletişim does not control or supervise user content in BiP. As a result, as far as technically and practically possible, and at our sole discretion, we may subsequently check, audit, reject, change, or delete any User Content that we consider to be in violation of the Terms of Use. BiP İletişim makes no commitment to access or record User Content as it is sent, received, or used by you in any way.
Violations of Content If you believe that the content violates your or a third party’s rights, or the Terms of Use, please notify us by sending an e-mail to info@bip.com.
When sending notifications to us in this context, please include the following information in the e-mail:
(a) your name and contact details,
(b) the location of the allegedly infringing content on BiP, as well as how it is infringing (i) your rights, (ii) the rights of a third party you represent, (iii) or the Terms of Use, and
(c) a description of the right alleged to have been infringed and to whom it belongs.
BiP İletişim will take whatever actions or measures it deems appropriate in light of the nature of the content you have reported. This includes not taking any action if BiP İletişim determines that the content in question does not violate any person’s rights or the Terms of Use. BiP İletişim is under no obligation to negotiate or inform you about the transaction or transactions it has chosen to carry out in response to your notification.
BiP İletişim has the authority to suspend and terminate the accounts of users who violate the Terms of Use. Similar outcomes may occur if you abuse the notification channels.
The name, e-mail address, etc. that you send within the scope of your request is included in the content of your takedown request and may be shared with relevant persons, including the complainant. You can find detailed information on the processing of your personal data in the BiP Privacy Policy.
Problems and Legal Disputes in Service
Suspension and Termination The use of BiP in a manner that does not comply with the Terms of Use listed above and exceeds the scope of the license granted to you constitutes a serious violation of the Terms of Use and may result in one or more of the following acts:
(a) the immediate, temporary, or permanent termination of your right to use BiP, as well as the deletion of relevant user content,
(b) indemnification and/or compensation for all damages resulting from the breach on your part.
(c) sharing information about the alleged violation with the appropriate authorities, as and when deemed necessary.
What can be done in the event of a violation is not limited to the sanctions listed above; additional sanctions and legal remedies may be applied if BiP İletişim is deemed appropriate. As a result, you agree not to assert any rights against BiP İletişim.
Service interruption or modification BiP İletişim will make reasonable efforts to ensure the proper operation of BiP. However, in certain circumstances (force majeure, technical difficulties, maintenance, testing, or studies to ensure compliance with legal requirements, etc.), temporary interruptions may occur due to necessary updates. BiP İletişim reserves the right, at any time, to modify or discontinue the BiP service and/or the Contents, partially or completely, without prior notice or consent.
Disclaimer BiP İletişim reserves the right, without prior notice, to restrict access to BiP İletişim. BiP İletişim shall not be liable for any technical difficulties, errors, or deficiencies encountered while using BiP, as BiP will be unavailable at all times and for an extended period of time. If BiP İletişim becomes aware of such an error, it will make reasonable efforts to correct it as soon as possible.
Natural disasters, war, mobilization, fire situations, government and administrative authority decisions and similar situations that occur in a way and to a degree that will partially or completely, temporarily or permanently suspend and/or make impossible the Service are deemed Force Majeure. BiP İletişim shall not be liable to you in such cases for failing to perform its obligations.
BiP İletişim makes no commitments regarding the Service and provides it “as is” without any conditions or warranties. BiP İletişim is not liable for any loss or damage (whether direct or indirect) incurred as a result of the use of BiP. However, BiP İletişim’s total liability to you or your legal heirs with respect to the use of BiP or any request related to BiP is limited to the amount you paid to BiP İletişim for using BiP in the preceding twelve months.
Severability If any of these Terms is found to be invalid, the remaining terms and conditions shall remain valid to the maximum extent permitted by law.
Jurisdiction and Governing Law Any dispute relating to BiP shall be resolved by the courts and Enforcement Offices of the Istanbul Anatolian Courthouse, in accordance with Turkish law and notwithstanding any conflict of laws rules. BiP İletişim reserves the right, however, to bring a lawsuit against you in your country of residence or a relevant third country if you violate these Terms of Use.
