BiP is a free communication and lifestyle platform available to subscribers of all operators, offering instant messaging, voice and video calls, various services under the Discover section, and the ability to create channels to share diverse content with your followers, ensuring a seamless communication experience. BiP Terms of Use on this page (hereinafter referred to as “Terms”) covers basic information on the use of BiP mobile app and website (web.bip.com) (“Service”) as well as certain rules to ensure our Service is used appropriately.

We are aware that reading this text can be exhaustive. We are trying to be brief and to the point to save you the trouble. We recommend that you read these Terms carefully. You should agree to the Terms to use BiP. If you disagree with any part of this text, please do not use BiP. By registering to BiP or accessing BiP via web.bip.com, you will be deemed to have agreed to these Terms.

Turkcell İletişim Hizmetleri A.Ş. shall be entitled to stop your use of BiP if it detects or has reasonable doubt that you have failed to comply with these Terms. For further information, please see the “Suspension and Termination” heading.

In addition, BiP Privacy Notice exists regarding the processing of your personal data that you share to use the Service and that is generated during your use of the Service. Further details on the processing of your personal data are available here.

Application Ownership Information

BiP (including the mobile application software and source code) is provided by Turkcell İletişim Hizmetleri A.Ş. (“Turkcell” or “we”), registered at Aydınevler Mahallesi İnönü Cad. Küçükyalı Ofis Park B Blok Apt. No:20 Maltepe/Istanbul, with company number 304844 and tax number 87700134.

Depending on your geographical location, the features and services offered within BiP may vary based on your region and the operator you use. In this regard, you may enter into contractual relationships with third parties that Turkcell collaborates with. In such cases, the provisions of those contracts will also be valid along with these Terms.

General Terms

Age Limitation You must be 13 years of age or older to subscribe, register or share any Personal Data to the Services. In certain jurisdictions, the age may be older than 13, in which case, you must satisfy that age in order to become a subscriber/user.

Subscription/Registration You must create an account to use BiP. When registering, you must not provide false information, must use your current phone number, and must register with your new number if it changes. By registering for BiP, you agree to receive verification codes via SMS and/or phone calls from us or third-party service providers to verify your phone number.

Turkcell may take necessary actions specified under the “Suspension and Termination” section if it determines that you do not meet the membership requirements.

By signing up for BiP, you regularly share the phone numbers of some or all of your contacts, including BiP users with us to ensure BiP functions properly. You can find detailed information in the BiP Privacy Notice.

Your Account If you create a BiP account, you must keep your username, password, address, and payment information confidential and not share them with third parties. If you think or suspect that a third party has access to these information, please inform us immediately via info@bip.com.

Links Links redirecting to third-party websites from BiP are provided only for your convenience or to facilitate communication with other users. If you follow these links, you will leave BiP. Turkcell does not control these websites and is not responsible for their content or accessibility. Turkcell does not endorse or represent these websites or the materials they contain. Accessing third-party websites through BiP is entirely at your own risk

Amendments and revisions Turkcell reserves the right to revise and amend these Terms at any time. You are responsible for checking this section periodically to stay informed about any changes. If the changes are significant, we may provide more noticeable notifications (including via email or through BiP).

Transfer Turkcell may freely transfer BiP and/or its rights and obligations under these Terms to any third party or entity without prior notice. This does not affect the obligations you must fulfill under these Terms. However, you may not transfer or assign your rights, obligations, or responsibilities under these Terms to any third party under any circumstances.

Principles of Use

This section covers other specific rules applicable to the use of BiP in addition to the requirements stipulated in these Terms.

While using BiP, you agree that:

  • you will not provide inaccurate information for your account, not allow third parties to use your account and not share your account login information – password etc. – with third parties, not act on behalf of a third party without their consent or pretend to be acting on behalf of a third person, institution or organization;
  • you will not use BiP for disseminating false, misleading, deceptive information or for illegal or unauthorized communication (for example, bulk message, automatic message, automatic search etc. for marketing and advertising purposes);
  • you will not use BiP in a way that will not be compatible with personal use and in a way that will not be considered normal;
  • you will not use BiP for commercial purposes unless permitted by Turkcell;
  • you will be personally responsible for the use and management of all information that allows you to use BiP, any process performed using your devices or accounts will be deemed performed by you, and you will be solely responsible for the damages arising from the direct or indirect use, loss or transfer of such information (for example, if you forget to log out after logging in from a third party device, access to your account is lost and/or your account is accessed by third parties);
  • you will not modify, disrupt or hack BiP, disable the features which ensure the security or protection of the contents, alter BiP via methods such as reverse engineering etc. or support third parties who attempt to do so;
  • you will not intentionally damage BiP and Turkcell or any user hardware with trojans, worms, logic bombs, script automation tools or similar materials or misuse BiP in a manner to cause a negative impact on user experience or use any automation tools or other functions to gain access to BiP (such as robots, spiders, scrapers, etc.) or use BiP for data collection purposes such as data mining, etc. or support third parties with such intentions;
  • you will not copy, duplicate, delete, change, distribute, expose, process, or publish the contents, or attempt to do so;
  • you will not use BiP in a manner to result in a criminal act, require legal proceedings, be in or encourage breach of national or international laws and regulations or to contain illegal, threatening, disturbing, insulting, invective or defaming contents, be depreciatory, vulgar, graphic, a crime against public order, immoral, disturb or harass others, attack personal rights, or be in breach of the confidentiality rights or private life or other proprietary rights of third parties;
  • if you create a channel on BiP; you are responsible for reading the informational messages provided to you. If you share content with your followers via your channel, you are solely responsible for such content. Your content must comply with laws, public morals, and societal values. It must not serve political purposes, infringe on intellectual or industrial property rights, or target any individual, public, or private institution.

Otherwise, you agree and undertake that you will be responsible for any of the above actions if any of them are performed using your device or registered account. Failure to comply with these principles may result in the suspension or termination of your account and legal consequences.

Pricing, Renewal and Cancellation

Pricing BiP is offered free of charge.

You are responsible for the internet access required to use BiP and any associated costs. Turkcell is not liable if you are unable to access BiP or fully utilize it due to issues related to your internet service provider.

To ensure BiP functions properly, you must use the latest version of the application. Supported devices and versions are listed on BiP’s app store pages. Older versions of BiP may be phased out at Turkcell’s discretion. Turkcell holds no liability if you cannot access or fully utilize BiP due to using an outdated version.

Renewal and Cancellation If you want to terminate your BiP subscription/registration, simply delete your account on BiP and delete the BiP application from your device by following the instructions in your BiP settings and of your device manufacturer.

 

Intellectual Property Rights, Contents and Licenses

Intellectual Property Rights Turkcell is the owner or maintains the right for the use of the BiP application, BiP brands, commercial names, logos, domain names, and all other elements of the BiP brand and the Contents excluding the open-source codes used in BiP. The aforementioned rights are globally protected by intellectual property laws and international agreements. Open-source codes used in BiP and principles on the use of these open-source codes are available under the “Copyright” tab in the Help section under the Settings tab in BiP. You can use the open-source codes only in compliance with such terms of service.

License granted to you to use BiP Subject to your acceptance of these Terms, you will be granted with a non-exclusive, non-assignable, revocable and limited-time license to use BiP solely for personal and non-commercial use in compliance with these Terms excluding any available open-source codes. Therefore, please be informed that you will be under legal responsibility if you act in breach of this license.

BiP Contents Any contents in BiP (“Contents”) including those created by users (“User Contents”) are for the user’s personal use. Any commercial use of the Contents is prohibited. Otherwise, Turkcell reserves the right to claim compensation.

You agree that you will be solely responsible for any breach of intellectual and industrial property rights arising from your breach of these Terms or your use of the Services and we hereby declare that Turkcell may recover damages related with intellectual property rights that may arise due to your misuse of the Services as a user, only where lawful to do so.

User Contents and Rights Granted To Us By You You hereby agree that Turkcell will be entitled to use or allow third parties to use User Contents (for example CAPS and stickers created by users and content shared via BiP channels) made available for the use of third parties without paying any fee. In such a case, you grant an irrevocable, global, non-exclusive, free and permanent right to use, copy, reproduce, distribute, adapt, restructure, modify, publish, translate and sub-license the aforementioned User Contents.

The rights provided by you to us herein will be used in order to operate BiP correctly and properly and to provide our service to you (for example, publishing your profile information, photos and status updates, sending your messages to their recipients), limited to purposes written in the BiP Privacy Notice.

Turkcell does not control or supervise User Contents on BiP. We are entitled to control, supervise, reject, alter or delete User Contents which we deem to be incompliant with the Principles of Use at our sole discretion provided that it is technically and practically applicable. Turkcell does not undertake full or partial access to User Contents or their storage in any form as sent, received or used by you.

Infringement of Contents If you think that any of the Contents violates the rights of you or third-parties you represent or the Terms of Use, please inform us by sending an e-mail to info@bip.com.

In this context, when you send us a notification please make sure that you provide the following information in your e-mail:

(a) Your name and contact information;

(b) The location of BiP Content deemed to be in breach and the item breached: (i) your rights, (ii) rights of a third party you represent (iii) or the Principles of Use; and

(c) Definition, explanation of the right allegedly infringed and to whom it belongs.

Turkcell will proceed and take measures as it deems suitable for the Content you notify. No action will be taken in case Turkcell decides that such Content is not in breach of any rights or the Principles of Use. Turkcell is not obligated to negotiate with you or inform you regarding the action(s) it chooses to take upon your notification.

Turkcell is entitled to suspend or terminate user accounts which are in breach of these Terms. The same may be applicable if you misuse notification channels.

Potential Issues Regarding the Service and Legal Disputes

Suspension and Termination The use of BiP in breach of the Principles of Use or in a manner to exceed the scope of license will be deemed as material breach of the Terms of Use and may result in any of the following:

(a) Immediate, temporary or permanent termination of your access to BiP and deletion of the relevant User Contents;

(b) Compensation of the damages resulting from the breach by you;

(c) Sharing information on the breach in question with authorities if required, and to the extent required.

Actions to be taken in case of a breach are not limited to those listed above and Turkcell is entitled to take other measures or legal actions as it deems appropriate. You acknowledge that you cannot claim any rights from Turkcell in such cases.

Interruption or revision of services Turkcell will make the necessary efforts to ensure proper operation of BiP. However, temporary interruptions may be encountered under certain circumstances (force majeure, technical issues, maintenance, tests and actions taken to comply with legal requirements etc.) for required updates. Turkcell is entitled to alter or remove BiP services and Contents, in part or in full, temporarily or permanently, anytime, without prior notification or consent required.

Waiver Turkcell reserves the right to limit access to BiP at any time and without prior notification. Turkcell will not be under any liability for the inaccessibility of BiP anytime or for a certain period of time or technical problems, errors or failures you may encounter while using BiP. Upon being notified of such failure, Turkcell will make reasonable efforts to rectify such failure as soon as possible.

Force majeure includes natural disasters, war, mobilization, fire, government regulations, epidemic, pandemic, and other situations to the extent they prevent access to the Services in part or in full, temporarily or permanently and/or make access to Services impossible. In such a case, Turkcell will not be under any liability against you due to its failure to meet its obligations.

Turkcell does not make any commitments regarding the Service and offers the Service “as it is” without any guarantee or condition. Turkcell will not be responsible for any damages or losses (direct or indirect) arising from the use of BiP. However, Turkcell’s liability against you or your legal successors arising from or in connection with the use of BiP is in any case limited to the amount paid by you to Turkcell in the last twelve months for the use of BiP.

Severability If any provision of these Terms is deemed invalid or inapplicable, other provisions will continue to be valid and applicable to the extent legally possible.

Jurisdiction and applicable law Any dispute related with BiP will be solely subject to the Turkish law without any regard to the principle of conflict of laws and will be settled by Istanbul Anadolu courts and execution offices. However, Turkcell reserves the right to file a lawsuit in the country you reside or in a third country due to the breach of these Terms of Use.
